Nebraska Personal Injury Cases – Myth & Reality

After you’re injured in an accident, many of your friends and relatives become injury law “experts.”  You will get well meaning advice from these people but it’s worth what you pay for it.  These well-intentioned folks will give you some myths and old wive’s tales that reflect some of the common misperceptions surrounding Nebraska personal injury cases.

1.  Myth:  Pedestrians always have the right of way.

Reality: Pedestrians only have the right of way when they are in a crosswalk with a “walk signal” or within a crosswalk where there is no light.  Those crossing the street outside of these protected areas (“jaywalkers”) must yield the right of way to vehicles on the street.  In other words, it is very difficult for a “jaywalker” to win an injury case.

2.  Myth: If you are injured on somebody’s property, you automatically collect compensation for injuries.

Reality:  The law on slip and fall cases is entirely fault based.  If you are injured on somebody’s property, you must prove that your injury was caused by the negligence of the landowner.   Somehow, the landowner’s fault has to cause your accident and injury.

3. Myth: A formula decides the value of your case.

Reality:  If a formula decided the value of your case, you wouldn’t need a lawyer.  Unfortunately, it is much, much more complicated than that.  There are one of two ways to decide the value of a Nebraska personal injury case.  One way is to go to court and let a jury of 6 or 12 people decide the value. The other way is to accept the insurance company’s top dollar offer.

Ultimately, a settlement is an educated guess on how much a jury would award in your case.  Estimating the value of a case is more of an art than a science.  It’s not easy.
